Terms & Conditions of Sale

Contract / Order

All quotations or proposals given and all contracts made by Sensuous Lingerie for design, supply of goods, are subject to these conditions.

Any quotation or estimate given by Sensuous Lingerie is an invitation to the customer to make an offer open to acceptance by Sensuous Lingerie. A binding contract comes into place on receipt of the customer's signed order.

The contract constitutes the whole agreement between the parties and supersedes any prior contracts or agreements.

Without prejudice to the binding contract, the design or supply of any goods may be subject to change at the time. In any event of change, Sensuous Lingerie will advise the customer accordingly. In the event the customer wishes to change any part of the contract, Sensuous Lingerie will consider the request, but will not be bound to accept it. A new contract will be provided by Sensuous Lingerie for any changes or additional items agreed. No variations to the contract will be accepted unless agreed jointly by the customer & Sensuous Lingerie.

Prices

Prices agreed in the contract between the customer & Sensuous Lingerie may be subject to change. Sensuous Lingerie will inform the customer before proceeding with the contract of any changes.

Payment Terms

Payment terms will be as per each individual contract. If payment is not received from the customer, Sensuous Lingerie reserve the right to not proceed with the contract until payment has been received.

Delivery

Sensuous Lingerie Will use all reasonable endeavour to ensure any deliveries are met within the time scheduled. However, if for any reason beyond there control, Sensuous Lingerie will not be held responsible for late delivery dates.

Sensuous Lingerie reserve the right t provide deliveries in instalments, subject to availability. The customer will ensure that goods delivered , are inspected by them immediately after delivery. A notice of rejection on reasonable grounds must be made within 24 hours of delivery of goods. Damaged packages must be signed for as "Damaged". Sensuous Lingerie reserves the right to refuse any claim on these grounds except under these conditions. No returns may be made without prior agreement with Sensuous Lingerie. Any goods returned without prior authorisation from Sensuous Lingerie will be refused.

Title and Risk

Risk in any item shall pass to the customer at the time the goods are delivered at the customers premises.

Any item delivered to the customer remain the property of Sensuous Lingerie until paid for in full. Until title is passed to the customer, the following terms and will be in place.

  1. Sensuous Lingerie reserve the right, without prior notice to the customer, responses and resell the goods and items if the sum due has not been paid in full on the due date has not been paid by the customer under the contract, or any other contract which has not been paid in full on the due date of payment. To exercise these rights, Sensuous Lingerie employees or agents reserve the right to enter the customer's premises at any time and without prior notice, with any vehicles Sensuous Lingerie considered necessary to remove such goods and items, and any access to there premises should be kept free from the customer.
  2. The customer shall keep the goods and items in the same conditions as they were in when delivered by Sensuous Lingerie, or agents on behalf or Sensuous Lingerie. Any damage to such goods and items shall be charged to the customer at full cost of replacement.
  3. From the date that risk passes to the customer, the customer should ensure that adequate insurance cover has been taken out until the full title passes to the customer.

Warranty and Limitation Liability

In agreement with the customer and Sensuous Lingerie any goods or item which has material or design defect will take the following action: Replace such goods or item without charge.
